TK SHOP Terms of Use

1. Acceptance of Terms of Use

By accessing or using the TK SHOP Platform, you confirm that you accept this agreement and agree to comply with it. If you are using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these conditions.

2. Changes to Terms of Use

We may modify these conditions at any time. Any changes will be effective immediately upon posting the updated agreement on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the new conditions. It is your responsibility to review this document periodically.

3. Account Registration

To access certain features of the Platform, you may need to register for an account. Under our legal agreement, when you register, you agree to:

• Maintain and promptly update your information
• Keep your password secure and confidential
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may be able to post, upload, submit or otherwise make available content on our Platform, including product reviews, comments, and profile information ("User Content"). By providing User Content, our agreement states that you grant TK SHOP a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

According to our legal conditions, you represent and warrant that:

• You own or have the necessary rights to the User Content
• The User Content does not infringe on any third party's intellectual property or other rights
• The User Content complies with these conditions and all applicable laws

6.1 Product Information

As stated in our legal document, we strive to provide accurate product descriptions, pricing, and availability information. However, we do not guarantee that product descriptions or other content on the Platform are accurate, complete, reliable, current, or error-free. In the event of a pricing error, we reserve the right to cancel any orders placed for products listed at an incorrect price.

6.2 Orders and Acceptance

According to our Terms of Use, your order represents an offer to purchase a product, which is accepted when we confirm your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or fraud detection.

6.3 Payment

Our Terms of Use requires you to provide current, complete, and accurate purchase and account information for all purchases made on the Platform. You agree to promptly update your account and other information so that we can complete your transactions and contact you as needed.

The Platform and its entire contents, features, and functionality (including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software) are owned by TK SHOP, its suppliers, or its licensors and are protected by Australian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These conditions do not transfer any ownership rights or grant any license to you to use any intellectual property of TK SHOP or any third party, except for the limited right to use the Platform as set forth in this agreement.

8. Third-Party Links and Content

The Platform may contain links to third-party websites or services that are not owned or controlled by TK SHOP. Our legal terms clarify that we have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge that TK SHOP shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any third-party websites or services.

9. Disclaimer of Warranties

Per our agreement, the Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

TK SHOP does not warrant that the Platform will function uninterrupted, secure, or available at any particular time or location, or that the results of using the Platform will meet your requirements.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TK SHOP, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.

11. Indemnification

Under this legal agreement, you agree to defend, indemnify, and hold harmless TK SHOP, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these conditions or your use of the Platform.

12. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any dispute arising from or relating to these legal terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Australia.

13. Severability

If any provision of these legal conditions is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14. Termination

Our platform policies allow us to terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these conditions. Upon termination, your right to use the Platform will immediately cease.

15. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitutes the entire agreement between you and TK SHOP regarding your use of the Platform and supersedes all prior and contemporaneous written or oral agreements between you and TK SHOP.
